These Terms & Conditions (“Terms”) govern your access to and use of rightchoiceoutdoor.com, myers-mowers.com, and nwapowerequipment.com (the “Sites”) and the products and services provided by Right Choice Outdoor Products, LLC (“Right Choice,” “we,” “us,” “our”). By accessing our Sites, contacting us, requesting service, purchasing products or parts, scheduling delivery, or otherwise using our services (collectively, the “Services”), you agree to these Terms.

If you do not agree to these Terms, do not use the Services.

2) Changes to These Terms

We may update these Terms from time to time. If we make changes, we will update the “Last updated” date and post the revised Terms on the Sites. Your continued use of the Services after changes are posted means you accept the updated Terms.


3) Use of the Sites

You agree to use the Sites and Services only for lawful purposes. You may not attempt to:

  • gain unauthorized access to the Sites or our systems,
  • disrupt or interfere with the security or operation of the Sites, or
  • introduce malicious code (viruses, bots, scraping tools, etc.).

We may suspend or restrict access to the Sites for any misuse or suspected misuse.


4) Products, Pricing, and Availability

Prices, promotions, product descriptions, and availability may change without notice and may vary by location.

We attempt to display accurate information, but we do not guarantee that all product descriptions, photos, specifications, pricing, or availability are error-free. If an error occurs (including a pricing error), we may correct it and may cancel or refuse an order.


5) Quotes and Service Estimates

Any quote or estimate is valid only for the time stated on the quote.

Service estimates may change if additional issues are discovered during diagnosis or repair. We will make reasonable efforts to contact you for approval before performing additional work that materially changes the estimate.


6) Orders, Deposits, and Payment

You agree to provide accurate and complete information for purchases and service.

Deposits / Down Payments

Down payments or deposits on units are non-refundable, unless otherwise required by law or stated in writing by Right Choice.

Payment Processing

We may use third-party processors to handle payments. Sales tax will be applied where required.


7) Pickup, Delivery, and Shipping

Pickup

You are responsible for inspecting products at pickup. Once a product leaves our premises (or is loaded for transport), you accept it in its then-current condition, subject to any applicable manufacturer warranty.

Delivery

We offer pickup and delivery services. Delivery dates and times are estimates and are not guaranteed. You are responsible for ensuring the delivery location is accessible and safe.

Occasional Shipping

We may offer shipping in limited cases. Shipping availability, costs, and timelines vary by item and destination. Risk of loss typically passes to you upon tender to the carrier (unless otherwise required by law or specified in writing).


8) Returns, Refunds, and Exchanges

Return eligibility may vary by product type. Unless otherwise required by law, the following rules apply:

  1. Original packaging required. Items must be returned in the original package.
  2. Receipt required. A receipt is required for full credit consideration.
  3. Restocking fee. Returned parts are subject to a 10% restocking fee.
  4. No returns on electrical parts. Electrical parts are not eligible for return.
  5. Special-order parts. All special-ordered parts must be paid for in advance. If not picked up within 60 days, they may be returned to the manufacturer and will not be eligible for a refund.

We reserve the right to deny returns that show signs of installation, damage, misuse, missing components, or non-compliance with these Terms.


9) Used Equipment Sold “AS IS”

All used equipment is sold “AS IS” and “WITH ALL FAULTS.” Right Choice makes no store warranty on used equipment unless specifically stated in writing.


10) Warranties

Manufacturer Warranties

Right Choice honors manufacturer warranties for brands sold by the store, where applicable and subject to the manufacturer’s warranty terms and approval.

No Store Warranty on Goods Sold

Right Choice does not offer a store warranty on goods sold (new or used), except as may be required by law or as expressly stated in writing.

Service/Labor Warranty

Right Choice warrants its labor for repairs for 30 days from the date of completion (or invoice date), unless otherwise stated in writing. This labor warranty does not cover:

  • failures caused by misuse, neglect, improper operation, accidents, or unauthorized modifications,
  • normal wear and tear,
  • issues unrelated to the specific repair performed, or
  • parts failures covered by a manufacturer warranty process.

11) Service Department Terms

Authorization

By approving service work, you authorize us to:

  • perform diagnostic and repair work as agreed, and
  • operate equipment as reasonably necessary to diagnose, test, and confirm repairs.

Storage Fees

If equipment is not picked up within a reasonable time after we notify you that service is complete, storage fees may apply as permitted by law. (If you want, I can add your exact daily/weekly fee schedule here.)

Abandoned Equipment

Equipment left for an extended period may be considered abandoned and handled in accordance with applicable law, which may include sale or disposal to recover unpaid balances, storage, and related costs.


12) Safety and Proper Use

Outdoor power equipment can be dangerous. You are responsible for reading manuals, following safety instructions, and ensuring safe operation and supervision by all users.


13) Promotions

Promotions, coupons, and special offers may have additional terms, expiration dates, exclusions, or limits. We may modify or end promotions at any time unless prohibited by law.


14) Intellectual Property

All content on the Sites (text, images, logos, design, and other materials) is owned by or licensed to Right Choice and protected by applicable intellectual property laws. You may not reproduce or distribute Site content without written permission.


15) Third-Party Links

The Sites may include links to third-party sites. We are not responsible for third-party content, policies, or practices.


16) Disclaimer of Warranties

To the fullest extent permitted by law, the Sites and Services are provided “AS IS” and “AS AVAILABLE.” We do not guarantee uninterrupted or error-free operation.

Some states do not allow certain disclaimers, so parts of this section may not apply to you.


17) Limitation of Liability

To the fullest extent permitted by law, Right Choice will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues.

Right Choice’s total liability for any claim relating to the Services will not exceed the amount you paid for the specific product or service giving rise to the claim, unless a higher amount is required by law.


18) Indemnification

You agree to indemnify and hold harmless Right Choice and its owners, employees, and agents from claims arising out of your misuse of the Services, your violation of these Terms, or your violation of any law or third-party rights.


19) Governing Law and Venue

These Terms are governed by the laws of the State of Arkansas, without regard to conflict of law principles. Any dispute shall be brought in the state or federal courts located in Benton County, Arkansas, unless otherwise required by law.


20) Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
